As we perform a Phase I environmental site assessments for many of our clients, we find a few small things that are simple and easy, value added, features. One of these most recent add-ons is the evaluation of storm water practices including the property’s Storm Water Pollution Prevention Plan (SWPPPs), and Best Management Practices (BMPs).
The Regional Water Quality Control Boards (RWQCBs) have been increasing the regulations over the past couple of years on Total Maximum Daily Loads (TMDLs) for surface water ways – lakes and streams. There are heavy fines associated with these very stringent rules and they are therefore becoming a very important factor in the management of financial risk associated with owning a piece of property. This is particularly important while development is ongoing, say a residential housing development.
